Set forth herein the terms and conditions that apply to the access and use of the domain name makeloaneazy.com and its related sub-domains, sites, services, tools and its associated mobile applications (collectively, the "Platform") is owned, managed and operated by Make Loan Eazy, with its office at LG-1330 Sec-46, Gurgaon, Haryana (hereinafter referred to as "we", "our", or "Make Loan Eazy" which expression shall, unless it be repugnant to the context or meaning thereof, be deemed to include its successors, affiliates, and permitted assigns) and by "you" we refer to the users of the Platform.
Please read these Terms of Service carefully ("Terms" or "Terms of Service"), as it contains the terms and conditions governing your use of the Platform and any content such as text, data, information, software, graphics, audio, video or photographs etc. that Make Loan Eazy may make available through the Platform and any services that Make Loan Eazy may provide through the Platform. In order to use the Platform, you must first agree to the Terms. By accessing, browsing or otherwise using the Platform, you are agreeing to be bound by the Terms and concluding a legally binding contract with Make Loan Eazy. Please do not access or use the Platform if you do not agree with any of the Terms provided below or are unable to be bound by them.
In addition, if you visit any of our partner financial institutions' websites/platforms or arrive at our Platform through one of our partner platforms, you may also be subject to the terms and conditions of the website/platform of our partners. As a condition of your access to and use of the Platform, you hereby agree that you will comply with all applicable laws and regulations when using the Platform.
Make Loan Eazy reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Service, at any time and will notify you by email or post a conspicuous notice on the Platform in the event of any material revisions to these Terms. It is your sole responsibility to review these Terms periodically for updates or changes. Your continued use of the Platform following the posting of changes shall be deemed to mean that you accept and agree to the revisions made to the Terms of Service. As long as you comply with these Terms, Make Loan Eazy grants you a personal, revocable, non-exclusive, non-transferable, limited privilege to access and use the Platform.
If you are unwilling or unable to be legally bound by these Terms, please do not use the Platform. You cannot accept these Terms if: (a) you are not lawfully entitled to use the Platform or (b) if you are not of legal age (18+) to form a binding agreement with Make Loan Eazy.
Use of the Platform is available only to persons who can enter into legally binding contracts under the Indian Contract Act, 1872 and is not a person barred from receiving services under the laws of India or other applicable jurisdiction. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents and persons of unsound mind are not eligible to use the Platform.
Any person under the age of 18 (eighteen) shall not register on the Platform and shall not transact on or use the Platform. If a minor wishes to use or transact on the Platform, such use or transaction may be made by the minor's legal guardian or parents on the Platform. Make Loan Eazy reserves the right to terminate any person's membership and/or refuse to provide such person with access to the Platform if it is brought to our notice or if we discover for ourselves that such person is not eligible to use the Platform.
Make Loan Eazy provides an independent online service which facilitates your access to information primarily about personal loans, loans against mutual funds, credit score tracking, and related financial services provided by our partner financial institutions whilst using this Platform. We may receive a fee and/or commission from such partners when you use our service to apply for products or avail services from them.
Make Loan Eazy does not charge any registration, membership, or browsing fee to consumers. However, Make Loan Eazy reserves the absolute right to charge any fee for registration/membership or browsing at any time. All such fees that Make Loan Eazy may charge will be informed to users by posting them on the Platform, and such change shall automatically become effective immediately after they are posted on the Platform. All such fees charged by Make Loan Eazy shall be in Indian Rupees. Your continued use of Make Loan Eazy shall be deemed as an acceptance of the amended terms of the Terms of Service from time to time.
You can accept the Terms by: (a) Signing up and logging onto the Platform by using Login Credentials; or (b) Actually using the Platform, in which case you understand and agree that Make Loan Eazy will treat your use of the Platform as acceptance of the Terms from that point onwards.
The Platform allows only limited and restricted access to the services for unregistered users. In order to use the Platform, you will have to create an account by signing up on the Platform ("Account"), which can be done by providing/using: (a) your cell phone number with password or OTP; or (b) email address with password; or (c) google or other social media logins; or (d) such other login credentials that are adopted by the industry for setting up an Account with the Platform.
Upon entering the required details, you may either receive a "One Time Password" (OTP) for the purpose of verification of your Account or your Account may be verified by using google or other social media logins or industry auto-verification processes. Upon completion of verification, the Account is created and ready for use. You shall not transfer or share your Account information with anyone or create more than one Account.
Once registered, in order to log into the Account on the Platform, you will be required to provide your Login Credentials. Upon being successfully registered on the Platform you will be provided access to a dashboard which shall enable you to access your account details and details of the loans applied for.
You shall be solely responsible for maintaining confidentiality of the Login Credentials, and to the extent allowed by law, you hereby accept responsibility for all activities on the Account authenticated through the Login Credentials, whether authorized or not. You agree to keep Login Credentials confidential and secure, and you shall not give or make Login Credentials available, directly or indirectly, to any unauthorized individual.
Make Loan Eazy cannot and will not be liable for any loss or damage arising from or arising out of your use of the Platform, theft of the Login Credentials, use of the Login Credentials or release of the Login Credentials to a third party or your authorization to allow another person to access and use the Platform using the Account.
In case of any misappropriation or unauthorized access of the Account, you agree to communicate the same to Make Loan Eazy immediately. You shall further ensure that you exit/logout from the Account at the end of each session.
You agree that the information provided by you to Make Loan Eazy at all times (including during registration and loan applications) will be true, accurate, up-to-date, and complete. If you provide any information that is untrue, inaccurate, not up-to-date or incomplete, Make Loan Eazy reserves the right to indefinitely suspend or terminate your access.
You hereby by way of accepting these Terms consent to the receipt of communication from Make Loan Eazy by way of Short Message Service (SMS) messages, e-mails, promotional calls, WhatsApp, and newsletters. These communications relate to your registration, loan status updates, transactions that you carry out through the Platform, and promotions undertaken by Make Loan Eazy.
Make Loan Eazy may, from time to time, announce certain offers with intent to promote the Platform and/or services ("Promotional Offer(s)"). The Promotional Offer(s) are governed by these Terms of Service plus any additional terms and conditions prescribed for that specific promotion.
The Platform may contain or provide links and interactive functionality interacting with the websites or resources of third parties. Since Make Loan Eazy has no control over such third-party websites and resources, you acknowledge and agree that Make Loan Eazy is not responsible for and has no liability for the functionality, actions, inactions, privacy settings, privacy policies, terms, or content of any such websites or resources.
Your interaction with any third party accessed through the Platform is at your own risk. Before enabling any sharing functions or applying with partner lenders, Make Loan Eazy strongly recommends reviewing their respective terms and conditions and privacy policies.
You agree, undertake and covenant that, during the use of the Platform, you shall not host, display, upload, modify, publish, transmit, store, update or share any information that:
The Platform may allow you to post ratings, reviews, suggestions, comments, questions or other information ("User Content"). You, being the originator of the User Content, are solely responsible for what you upload, post, or publish on the Platform.
You hereby grant Make Loan Eazy a perpetual, non-revocable, worldwide, royalty-free and sub-licensable right and license to use, copy, distribute, display, publish, transmit, make available, reproduce, modify, and adapt the User Content.
Except for User Content, all content and services provided on the Platform, including text, software, scripts, code, designs, graphics, photos, trademarks, logos, trade names, and other intellectual property is owned by or licensed to Make Loan Eazy, and is protected by copyright, trademark, patent, and other intellectual property laws of India.
You may download material from the Platform only for your own personal, non-commercial use. Any reproduction, distribution, duplication, or commercial exploitation without our express written consent is strictly prohibited.
Your Account can be terminated at any time by: (a) You, by ceasing to use the Platform; or (b) Make Loan Eazy, in our sole discretion for any reason or no reason, including your violation of these Terms. Make Loan Eazy may immediately deactivate or delete the Account without prior notice.
You shall indemnify and hold harmless Make Loan Eazy, its owner, licensee, affiliates, subsidiaries, and their respective officers, directors, agents, and employees, from any and all claims, demands, or actions (including reasonable attorneys' fees) made by any third party due to or arising out of your breach of these Terms, Privacy Policy, or your violation of any applicable law.
These Terms shall be governed by and interpreted in accordance with the laws of India. The courts of Haryana/Delhi NCR shall have exclusive jurisdiction. In the event of any dispute arising out of these Terms, the same shall be settled by binding arbitration conducted by a sole arbitrator appointed in accordance with the Arbitration and Conciliation Act, 1996.
